RE: Notice of changes in payment standard for the Housing Choice Voucher program

Dear Owner/Representative

Beginning on 4/1/2018, the Housing Authority of Pompano Beach (HAPB) will be using a new method to calculate the amount of money we will pay towards rent and utilities for each family in our Housing Choice Voucher program. This new approach is required by the U.S. Department of Housing and Urban Development (HUD) for all public housing agencies that administer vouchers in Broward County area.

Under the new approach, the Housing Authority of Pompano Beach will no longer use Fair Market Rents (FMRs) for the entire metropolitan area to determine the payment standard that reflects the maximum amount of assistance we will pay toward rent and utilities.

Effective 4/1/2018, HAPB will switch to FMRs established at the ZIP code level, which are known as Small Area Fair Market Rents (SAFMRs). The use of multiple payment standards will allow us to provide rental assistance at levels that more accurately reflect the rents charged in individual neighborhoods.

Note: Payment Standards are between 90-110% of the HUD published SAFMR. This is in accordance with HUD Regulations. The amounts listed are the maximum subsidy standards the Housing Authority of Pompano Beach (HAPB) will pay on behalf of a family. The payment standard amount includes an allowance for any tenant paid utilities.

If payment standards will be reduced in ZIP codes where you own properties and rent units to voucher families, the Housing Assistance Payment (HAP) you receive from the HAPB may go down and the tenant may be responsible for a larger share of the rent.  Please be mindful of this shift as you consider changes to the rent in the future.

If payment standards will increase in ZIP codes where you own properties and rent units to voucher families, the portion of the rent for which the tenant is responsible may be reduced if they are paying more than 30 percent of their income for rent and utilities. Please be aware that all HAP contracts will remain subject to rent reasonableness determinations.

Families currently under HAP contract will not be subject to any applicable reductions in payment standard until their second annual reexamination after the date of the reduction. Any changes in your current tenants’ HAP and total tenant payment will be clearly communicated to you at least thirty (30) days in advance of the effective date.

FAIR HOUSING ACT

Title VIII of the Civil Rights Act of 1968 (Fair Housing Act), prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status (including children under the age of 18 living with parents or legal custodians, pregnant women, and people securing custody of children under the age of 18), and handicap (disability).

LEAD BASE PAINT

Many houses and apartments built before 1978 have paint that contains high levels of lead (called leadbased paint). Federal law requires that individuals receive certain information before renting, buying, or renovating pre-1978 housing: Landlords have to disclose known information on lead-based paint and lead-based paint hazards before leases take effect. Leases must include a disclosure about lead-based paint.

SECURITY DEPOSITS

Landlords are to use their own discretion for security deposits, however it is prohibited for the amounts to be in excess of local or state law and for amounts charged by the owner to unassisted tenants.

RENTING WITH SECTION 8

HAPB does not accept property information to post available units. The Housing Authority has partnered with www.Gosection8.com, which provides an enhanced program to list rental properties on line. Please note, as the Landlord, it is your responsibility to screen all prospective Tenants. If you wish to rent to HAPB Section 8 Voucher holders, it is suggested you list your property with GoSection8.com

HAP CHECKS

Payments are deposited into Landlords account within the first five (5) calendar days of the month or are available for pick up from the office after the second (2) business day of the month. HAP checks are not mailed.

The family is responsible to pay the difference between HAPB’s payment amount and the total contract rent. The family’s portion of rent is paid directly to the Landlord. Landlord may not charge the family in excess of the family’s portion of rent. Landlord must not collect rent for unoccupied units.

HOUSING QUALITY STANDARDS INSPECTION

Upon verifying the Landlord’s property documents an initial HQS inspection will be scheduled within five (5) business days. It is required for HAPB to inspect all units on an annual basis. A small percentage of units are randomly selected for Quality Control and Special Inspections are conducted upon request.

1. Moving to Work (MTW) – The HAPB will apply to HUD for MTW Status under Cohort #4-Landlord Incentives. Please see attached the MTW Flyer and the notification to Participants. The HAPB is inviting all HCV/Section 8 Participant to attend one of the two scheduled ZOOM Resident Meetings. Please see attached Resident Meeting Notice with meeting access information.

2. July 22, 2021 – City of Pompano Beach COVID-19 Emergency Rental Assistance Program: In response to the American Rescue Plan Act (ARPA) the City of Pompano Beach will provide much needed emergency rental assistance, covering rent payments for up to twelve months (including in arrears) to alleviate the housing burden for low income households that have experienced an economic hardship as a result of the COVID-19 pandemic. Assistance will be capped at $25,000 and could include first, last and security deposit and relocation assistance. Amounts in arrears prior to March 1, 2020 are not eligible for assistance. Additional information is available at City of Pompano Beach (pompanobeachfl.gov).

3. June 14, 2021 – Broward County Emergency Rental Assistance Program (ERAP) -providing rental assistance and utility payments for households affected by COVID-19.

5. April 28, 2020 – HUD’s Evictions Moratorium Flyer

6. April 14, 2020 – COVID-19 Rental Assistance Applications Available on Online: The City of Fort Lauderdale’s Housing and Community Development office will offer rental assistance to eligible residents of Fort Lauderdale who experienced job loss due to COVID-19. Funding is limited and assistance will be provided on a first-ready, first-served basis. Under the program, a lease agreement must already be in place, rental assistance will be paid directly to the landlord, and rents should be reasonable and meet fair market rent rates. Eligible residents will receive up to three months of assistance not to exceed a maximum of $5,000 in total benefits. Assistance is contingent upon available funding. Applications are currently available online at bit.ly/39ULt0k.

City of Pompano Beach Emergency Rental Assistance Program

In 2021, the City of Pompano Beach provided emergency rental assistance through funding associated with the American Rescue Plan Act. The program was created to assist qualifying households experiencing financial hardship related to the COVID-19 pandemic.

Broward County Emergency Rental Assistance Program

Broward County’s Emergency Rental Assistance Program provided rental and utility assistance to qualifying households financially impacted by the COVID-19 pandemic.

City of Pompano Beach 2020 Rental Assistance

This resource provides information about emergency rental assistance offered by the City of Pompano Beach during the COVID-19 pandemic.

HUD Eviction Moratorium Information

HUD provided information regarding temporary eviction protections implemented during the COVID-19 public health emergency. This information is historical and does not represent current eviction protections.

City of Fort Lauderdale 2020 Rental Assistance

The City of Fort Lauderdale offered temporary rental assistance for eligible residents who experienced financial hardship related to COVID-19. This information is provided for historical reference, and the original program may no longer be accepting applications.
